The concept of "custody" and "access" ceased to be part of English law on the 14th October 1991 following the implementation of the Children Act 1989. This Act gives us the concept of 'parental responsibility', which is defined as 'all the rights, duties, powers, responsibilities and authority which by law a parent of a child has in relation to the child and his or her property'. As a person with parental responsibility you have just that: responsibility for your child. You cannot give away your parental responsibility and it may be removed or suspended only in the most exceptional of circumstances. It exists in respect of every child until the child reaches the age of 18 but, inevitably, as your child gets older then it becomes less and less significant as your child is able to take more responsibility for their own behaviour and affairs. |
